Terms and Conditions of Use:

The OptionsTracking.com website is owned and operated by KlickTheWeb.com. The Terms & Conditions agreed to below pertain to OptionsTracking.com and KlickTheWeb.com, its associated services, and any third-parties. Please check the Agreement below before submitting your registration. The following are understood by the said user:
1. I understand that the first 30 days of access to OptionsTracking.com is free, and that at the end of that period, I must provide a valid credit card to have my subscription activated. I understand that my credit card will be charged with the subscription rate I have selected. I understand that all subscription plans will be billed automatically to my credit card for the selected rate on the first day following the completion of the previous subscription period. I understand that I can cancel my subscription at anytime by sending an email to sales@optionstracking.com., which when implemented, will cease any further charges to my credit card. There will be no partial refunds during the selected monthly subscription period. I further understand that there will by no refunds once the subscription period has begun. Yearly subscriptions have a built in discount. Therefore, yearly subscriptions that are canceled will be prorated and only the full unused months will be refunded after applying the prorated discount. I further understand and acknowledge that my credit card statement will reflect a charge by "KlickTheWeb" for services rendered as KlickTheWeb is the parent company for OptionsTracking.com.
2. I acknowledge and agree that all information contained within OptionsTracking.com is analytical in nature, and under no circumstances is the content to be construed as an offer to sell any stocks or options and/or a solicitation of an offer to buy any securities. Furthermore, OptionsTracking, and its associated parties do not have any intention to provide investment or other advice. All content employed by the visitor is at the visitor's own risk. The visitor holds harmless OptionsTracking.com, and its associated third parties.
3. I understand and agree that OptionsTracking.com, and its associated third parties are not stock brokers or investment advisers, and cannot provide recommendations to buy or sell securities of any type, shape, or fashion.
4. I understand and agree that although OptionsTracking.com believes the information provided on the website to be reliable, the user agrees and understands that the information provided by OptionsTracking is not guaranteed or under warranty of any kind, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purposes, non-infringement of third-party rights, and/or freedom from computer viruses. I understand that before I make any security transactions, I should consult with an accredited professional investment advisor and/or accredited stock broker to obtain their recommendations as well as to obtain the latest and most accurate stock and option data.
5. I agree to indemnify, release, and hold harmless OptionsTracking.com, KlickTheWeb, its' members, directors and affiliated third-parties against any claims, liabilities, damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this website, or use thereof or inability to use. OptionsTracking.com, their officers, members, directors, and affiliated third-parties shall not be responsible or subject to any liability or expenses of any kind arising from the timeliness, accuracy, truth, adequacy, or completeness of information provided on the website, failure of performance, errors, omissions, interruptions, delays in operation or transmission, expected financial results, computer virus, or any systems failure. I further agree that under no circumstances shall OptionsTracking.com, their officers, members, directors, and affiliated third-parties be liable to me for more than my subscription rate selected above.
6. I agree that access to OptionsTracking.com is for myself and only myself (one visitor), and that the issuance of my password to other non-subscribers is forbidden and will be a direct violation of this agreement. I agree that the information provided on OptionsTracking.com is to be kept secure and shall not be distributed to third-parties without the written consent of OptionsTracking.com. I agree that violations of this agreement will cause the immediate cancellation of my subscription and additional punitive action, if necessary. Attempts to copy or in otherwise duplicate the content, layout, functions, images and all other associated materials associated with OptionsTracking.com is strictly forbidden. Violation of these terms will result in immediate cancellation and will be subject to further punitive measures, when required.
7. This agreement shall be governed by and construed in accordance with the laws of the State of Florida in the United States of America, except those provisions of law pertaining to other jurisdictions. Any action arising from or pertaining to the use of OptionsTracking.com or pertaining to the subscription agreement are only subject to the courts of Santa Rosa County in the State of Florida.
8. I am at least 18 years of age.
9. Market data provided by CBOE, Inc. Data is delayed 20 minutes unless otherwise noted, and is believed accurate but is not warranted or guaranteed by CBOE Inc. All times are Eastern United States. By subscribing to this service I acknowledge that "I have read and agree to the Terms & Conditions of Use" as well as the "Disclaimer", I agree to be bound by those provisions.

Privacy:

We Collect Required Information - To open a OptionsTracking/KlickTheWeb account, you must provide your name, address, phone number, and email address. Our Use and Disclosure of Information Internal Uses - We use the information we collect about you in order 1) to provide our services, 2) to provide customer service, and 3) to improve our products and services. At your option we use the information you provide to access specific third party services on your behalf and perform the actions that you request us to perform. We give access to individually identifiable information about our users only to those employees or agents who require it to fulfill customer service requests. Disclosure to Third Parties - OptionsTracking.com and KlickTheWeb will not sell or rent any of your personally identifiable information to third parties. OptionsTracking.com and KlickTheWeb will not share any of your personally identifiable information with third parties except in the limited circumstances described below, or with your express permission. We share information with companies that help us provide the services you request.  We disclose information that we in good faith believe is appropriate to cooperate in investigations of illegal activity, or to conduct investigations of violations of our Terms of Use. We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action.  We disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).  As with any other business, it is possible that OptionsTracking.com and/or KlickTheWeb in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by OptionsTracking.com and KlickTheWeb, including customer account information, but would continue to be bound by this Privacy Policy unless and until it is amended. We communicate with users via e-mail for billing purposes and to provide requested services such as customer support, and we also communicate by phone to resolve customer complaints. We use your e-mail address to confirm your opening of an OptionsTracking.com - KlickTheWeb account, to send information about important changes to our products and services, and to send notices and other disclosures required by law. Generally, users cannot opt-out of these communications, but they will be primarily informational in nature rather than promotional.

Cancellations and Refunds:

Subscriptions can be canceled by sending an email to sales@optionstracking.com. Partial month refunds will NOT be issued for monthly subscriptions. Yearly subscriptions have a built in discount. Therefore, yearly subscriptions that are canceled will be prorated and only the full unused months will be refunded after applying the prorated discount.
